No matter what type of business you run, hotel, restaurant, caterer, farmer, etc. all are regulated by the Food Standards Agency (FCA) and are required to meet regulations such as The Food Safety Act 1990, and The General Food Law Regulation (EC) 178/2002 which dictates that:

“The requirement on food businesses to place safe food on the market, for traceability of food, for presentation of food, for the withdrawal or recall of unsafe food placed on the market and that food imported into, and exported from, the EU shall comply with food law.”

What happens if you’re non-compliant?

If you are found to not be compliant with food safety legislation then there are a number of possible outcomes:

  • You could be issued with an Improvement Notice from your local authority. This will allow you 21 days to fix or update anything which is non-compliant.
  • If you are found to be non-compliant to the point that it is an imminent risk to public health then this will result in an immediate closure of your business.
  • In cases of serious breach of food safety you could be prosecuted and receive a fine of up to £20,000
